Regulations on Handling the Property Found on the Premises of Warsaw/Modlin Airport

Article 1

These Regulations have been drawn up based on the following legal regulations:

  1. Lost and Found Property Act of 20 February 2015 (Dz.U. 2015.397), hereinafter referred to as the Found Property Act;

  2. Civil Code Act of 23 April 1964 (Dz.U. 2016.380, as amended) (also referred to as CC);

  3. Aviation Law Act of 2 July 2002 (Dz.U. 2016.605, as amended);

  4. Regulation (EC) No 300/2008 of the European Parliament and of the Council of 11 March 2008 on common rules in the field of civil aviation security and repealing Regulation (EC) No 2320/2002 (OJ L 97/72 of 09.04.2008, p. 72);

  5. Commission Implementing Regulation (EU) 2015/1998 of 5 November 2015 laying down detailed measures for the implementation of the common basic standards on aviation security (OJ L 2015.299.1, as amended);

  6. Regulation of the Minister of Transport, Construction and Maritime Economy of 4 September 2012 on the basic order regulations relating to ensuring flight security and order in airports (Dz.U. 2012.1023);

  7. Regulation of the Minister of Transport, Construction and Maritime Economy of 31 July 2012 on the National Civil Aviation Security Programme (Dz.U. 2012.912, as amended).

 

Article 2

 

Whenever the following terms are used in these Regulations they shall have the following meaning:

  1. Airport – Warsaw/Modlin airport registered in the register of civil airports kept by the President of the Civil Aviation Office;

  2. Operator – the operator of Warsaw/Modlin airport, i.e. Mazowiecki Port Lotniczy Warszawa-Modlin Sp. z o.o. with its registered office in Nowy Dwór Mazowiecki, ul. Gen. Wiktora Thommee 1 A, 05-102 Nowy Dwór Mazowiecki, entered into the register of entrepreneurs kept by the District Court for the Capital City of Warsaw, 14th Commercial Division of the National Court Register, at number KRS: 0000184990, share capital: PLN 323,824,500.00, REGON [National Business Registry Number]: 011248734, NIP [Tax Identification Number]: 522-10-25- 337;

  3. Security Services – Border Guard, Policy, Internal Security Agency and Airport Security Services implementing their tasks on the premises of the Airport;

  4. Property – every item (including every piece of luggage) left or found on the premises of the Airport;

  5. Lost and Found Property Office – the place of receipt and issue of found property, located at the airport information point, in the open hall of the Airport, phone no. +48 801 801 880, +48 22 315 18 80;

  6. Starost – administrator of the Nowy Dwór County Office (in Polish: Starostwo Powiatowe), address: Starostwo Powiatowe in Nowy Dwór Mazowiecki, ul. Ignacego Paderewskiego 1B, 05-100 Nowy Dwór Mazowiecki;

  7. Police – County Police Department, address: ul. Ignacego Paderewskiego 3, 05-100 Nowy Dwór Mazowiecki;

  8. Finder – the person who has found the Property in the premises of the Airport; the person handing over the Property to the Operator (the Lost and Found Property Office) shall in particular be deemed to be the finder;

  9. Liquids, aerosols and gels – the liquids, aerosols and gels within the meaning of point 4.0.4(a) of the Annex to the Commission Implementing Regulation (EU) 2015/1998 of 5 November 2015 laying down detailed measures for the implementation of the common basic standards on aviation security (OJ L 2015.299.1, as amended).

 

Article 3

To handling the property found on the premises of the Airport the provisions of the Lost and Found Property Act shall apply, subject to the provisions of these Regulations, in particular Article 4 hereof.

 

Article 4

  1. For security reasons you must not leave any Property unattended on the premises of the Airport.

  2. Any Property left unattended shall be examined by relevant services and its owner may be fined in accordance with applicable regulations.

  3. During examination the Property may be damaged or destroyed.

  4. Any liquids, aerosols and gels left or found on the premises of the Airport shall be disposed of.

  5. Any Property thrown into a dustbin or left immediately next to a dustbin shall be deemed left unattended and abandoned for the purpose of getting rid of it within the meaning of Article 180 CC, subject to paragraph 6.

  6. Throwing away any suitcases, backpacks, bags, etc. to dustbins shall be forbidden. The owner of such Property thrown away into a dustbin may be fined in accordance with applicable regulations.

 

 

 

Article 5

Whoever notices a Property left unattended on the premises of a terminal, in the car park in front of the terminal, on the access road to the terminal, on pathways or in any other place on the premises of the Airport SHALL HAVE THE OBLIGATION TO IMMEDIATELY INFORM Security Services or other employees of the Airport about it.

 

Article 6

 

  1. Receipt of any Property in the Lost and Found Property Office shall be confirmed by a relevant report – confirmation of receipt drawn up by a person operating the Lost and Found Property Office based on the template which forms Attachment No. 1 to these Regulations.

  2. Report – confirmation of receipt containing, depending on the type of Property (in the case of a packed piece of luggage – depending on the objects inside the luggage) the following information:

  1. precise name;

  2. quantity;

  3. detailed description;

  4. type/brand;

  5. colour;

  6. size;

  7. serial no.;

  8. full name and position of the person receiving the property;

  9. full name and position of the finder/the person handing over the Property;

  10. place of residence of the Finder/person handing over the Property;

  11. any other contact details provided voluntarily by the Finder (e.g. phone number, e-mail);

  12. date of finding;

  13. time of finding;

  14. place of finding;

  15. information on the right to demand finder's reward and terms and conditions of acquisition of property in the case of an ineffective expiration of a term for collection of the Property by an authorised person;

  16. if the Finder demands finder's reward – a note about it;

  17. consent for processing of personal data – if the Finder provides the voluntarily provided data.

 

  1. The report referred to in Article 6.2 shall also be drawn up if the Finder indicates location of the Property.

  2. The report referred to in Article 6.3 and 6.3 shall be drawn up in two counterparts, one of which shall be kept by the Operator whilst the other one shall be provided to the Finder/person handing over the Property.

 

Article 7

 

  1. The owner may collect his or her Property from the Airport, only personally and at the Airport, for 3 days from the date on which the Property was found on the premises of the Airport.

  2. In order for the Property to be issued to the person authorised to collect it the person collecting the Property shall:

 

    1. present a detailed description of the Property, including characteristic features of the Property, or documents confirming that he or she is the Property owner;

    2. present a document confirming his or her identity;

    3. pay the costs of storage and maintenance of the Property in the right condition. Such a fee at the amount of PLN 20 gross shall be paid to the Operator in the Lost and Found Property Office located in the open hall of the terminal, subject to the fact that in the case of a packed piece of luggage the amount of PLN 20 shall be collected on every piece of luggage. The fee can be paid only in cash.

  1. The person operating the Lost and Found Property Office shall copy the documents confirming ownership of the Property.

  2. When issuing the Property to the person authorised to collect the Property the person operating the Lost and Found Property Office shall:

    1. verify identity of the person authorised to collect the Property;

    2. draw up a report on issue of the Property.

 

Article 8

  1. Three days from finding or receiving the Property the Operator shall hand over the Property to the Starost.

  2. If a pay card or credit card is found or turned in to the Operator, the Operator shall immediately inform a relevant bank of finding such a card and shall send it, by registered letter, to the bank which issued the card.

 

Article 9

 

  1. The Operator, that is Mazowiecki Port Lotniczy WarszawaModlin Sp. z o.o. with its registered office in Nowy Dwór Mazowiecki, ul. Gen. Wiktora Thommee 1A, 05-102 Nowy Dwór Mazowiecki, is the controller of the personal data.

  2. Personal data shall be processed pursuant to the Lost And Found Property Act and civil aviation security regulations, in particular the legal acts indicated in Article 1 of the Regulations - available at the airport information desk

  3. The data subject shall have the right to access his or her personal data and to have them corrected - available at the airport information desk
